Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between Airbrush Enhancer (“we,” “our,” or “us”) and the individual or entity (“you,” “your,” or “User”) accessing or using airbrushenhancer.com. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Service.

You may use the Service only if you are at least 13 years old and register with a lawful personal email address that you control.

Airbrush Enhancer provides AI-driven image enhancement solutions, including but not limited to upscaling, resolution improvement, and visual quality optimization.

• Credit System: The Service operates on a  “Credit” basis. Credits are purchased by the User and consumed for each image processed.
• Processing Flow: After upload, submitted images undergo automated NSFW compliance checks. Only compliant requests are sent to AI model providers for processing and returned to the user.
• Service Changes: We reserve the right to modify, suspend, or discontinue any part of the Service. We will notify users of material service changes via website announcements (broadcast notices).

• AI Technology: The Service utilizes third-party artificial intelligence models and providers to process images. You acknowledge that AI outputs are generative and we do not guarantee that the enhanced images will meet your specific expectations. We use AI safety controls and model-level filtering to reject requests involving infringing, illegal, or NSFW content. Submitted images are processed by trusted third-party AI providers. Based on the representations of our third-party providers, submitted images are not retained for long-term storage, publicly disclosed, or used for model training. However, we do not control third-party practices and cannot guarantee their behavior.
• Service Providers: We use Supabase for account registration data and usage records, Replicate for AI image model processing, and Creem for payment processing and billing operations.
• Payment Processing: Our payments are supported and processed by Creem. All transactions, billing security, and invoice management are subject to Creem's terms of service and privacy policy. We do not collect or store your payment card or billing details on our servers.

As a condition of using the Service, you agree:

• Content Legality: You represent that you own or have the necessary licenses and consents for all images uploaded. All content must comply with our Acceptable Use Policy (AUP).
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Prohibited Conduct: You shall not reverse engineer, scrape, bypass rate limits, or use automated scripts to abuse the Service's resources.
• Repeated NSFW Violations: Repeated attempts to submit prohibited NSFW content are strictly prohibited.
• System Attacks: Any malicious activity, including attacks on infrastructure, security controls, or service availability, is prohibited.

• Payment Provider: All purchases are handled through our merchant of record, Creem.
• Refund Requests: If you wish to request a refund, you must submit the request directly through the Creem platform.
• Eligibility: Refunds are only eligible if the purchased Credits remain unused (zero consumption). Once any credits from a transaction have been consumed for image processing, the service is deemed fulfilled, and no refund will be issued.
• Final Decision: All refund determinations are subject to Creem's policies and our internal verification.
• Termination Consequence: If an account is terminated for repeated NSFW violations or malicious attacks, remaining account rights and credits are forfeited and are not refundable.

1. Service Overview: This service provides AI-assisted processing and enhancement of user-submitted content. We aim to deliver a reliable and high-quality user experience through continuous improvements and optimization.
2. AI-Generated Results: Our service utilizes artificial intelligence models, including those provided by third-party providers such as Replicate. Due to the inherent limitations of AI technology, results may vary and are not guaranteed to be accurate, complete, or suitable for any specific purpose.
3. No Warranties: The service is provided on an “as is” and “as available” basis. While we strive to maintain a reliable, secure, and high-performing service, we do not warrant that the service will be uninterrupted, error-free, or fully secure at all times. We do not guarantee that the service will be available at all times or in all regions.
4. Third-Party Dependencies: Certain features of the service rely on third-party infrastructure and services. We are not responsible for the performance, availability, or reliability of such third-party providers.
5. User Responsibility: You are solely responsible for the content you upload, process, or distribute through the service. You represent and warrant that you have all necessary rights, permissions, and authority to use such content.
6. Limitation of Liability: To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

   Our total liability for any claims arising out of or related to the service shall not exceed the amount you paid (if any) to use the service within the preceding twelve (12) months.

7. No Professional Advice: The outputs generated by the service are for general informational and utility purposes only and do not constitute professional advice of any kind.
8. Acceptable Use: You agree not to use the service for any unlawful, harmful, abusive, or infringing activities, including but not limited to violating intellectual property rights or applicable laws.

• Platform Ownership: The Service, its original content, features, and brand assets are the exclusive property of Airbrush Enhancer.
• User Content: You retain ownership of your original images. By using the Service, you grant us a limited, worldwide license to process your images solely for the purpose of providing the enhancement service.

• We may suspend or terminate accounts that repeatedly violate NSFW rules or engage in malicious attacks against the Service.
• We may take immediate enforcement action to protect users, infrastructure, and legal compliance.
• Upon termination for policy violations, remaining credits and account-related rights are forfeited and are not refundable.

You agree to defend, indemnify, and hold harmless Airbrush Enhancer, its operators, affiliates, partners, and service providers from and against any and all claims, damages, liabilities, losses, costs, and expenses (including, without limitation, reasonable attorneys’ fees) arising out of or related to:

• (a) any content you upload, submit, process, or distribute through the service;
• (b) your use or misuse of the service;
• (c) your violation of these Terms or any applicable laws or regulations;
• (d) any claim that your content or use of the service infringes or violates any third-party rights, including intellectual property or privacy rights;
• (e) your use of, reliance on, or distribution of AI-generated outputs.

This obligation shall survive the termination or expiration of your use of the service.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law principles.

In the event of a dispute, both parties agree to first attempt good-faith resolution through direct communication. If the dispute is not resolved, it shall be submitted to the courts of competent jurisdiction in Shanghai, China.

We may update these Terms from time to time. For major changes, we will post a prominent notice on the homepage.

Continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.
